General rules and conditions of use fort he use of the I.C.E: webpages.
Welcome to the website of Immobilien Connaisseur Europa S.L. (following named: I.C.E. S.L.) .

These are the Geeneral Rules of Business of I.C.E. S.L: (following called GRBs):
The are governing the relations resulting from a contract between I.C.E. S.L. and all individual or judicial entities, that are using the real estate services of I.C.E. S.L. The GRBs apply to the use of the webpages of I.C.E.de, es, at and .com Die AGB betreffen die Nutzung der Webseite ICE de, at und .com, as well as all their related sub-domains (following called ICE-webpages)
By clicking on the link info@ice-europa.de , you are accepting the following stated GRBs of I.C.E. S.L. and are entereing into a contract with I.C.E. S.L. fort he use of the ICE webages, where your real estate property will be offered for sale or purchased. For further information relating to the fees for use and sales, please turn to chapter "FEES". You may cancel your agreement with the sales contract and these GRBs in writing within 2 weeks. For this please write to us at I.C.E. S.L., Ronda Carlos V, 2B-bajos, E-07620 Llucmajor, Mallorca Baleares. Or send an email to info@ice-europa.com To maintain the statutes of limitations it is sufficient to mail your cancellation within said timeframe. If you state your cancellation on time, you are not legally bound to neither this agreement with our GRBs nor the conditions of the sales contract. This cancellation becomes invalid as soon as you have received an offer to purchase your real estate property or your property has been sold.
REGISTRATION
1.   Use of the tele services of the ICE-webpages is based on prior registration. There is no legal requirement to register with ICE-webpages. Registration is free of charge. Registration is based on your agreement with these GRBs. By registering, you are entering into a contract with I.C.E. S.L. whereby offering your property for sale.
2.   Registration is only permitted to judicial entities or individuals of full legal capacity.
3.   The date and information requested by I.C.E. S.L. for registration have to be made correctly and completely, for example First- and family name, current address (no P.O.Boxes), telefone number, a valid email address as well as business contact information for judicial entities. The registration of a judicial entity may only be made by a legal representative, who has to be named in person. In the event that any of the given information changes after the registration process, the contract partner is responsible for the immediate notification of I.C.E. S.L. of any such changes.
4.   ICE receives the permission, to use the information and photos provided with the registration to publish such materials in the ICE webpages fort the duration of the advertisement.

Duration of Contract
1.   1 The general duration of the contract is 3 years.
2.   The contract terminates after 3 years, if it is cancelled 3 months before the termination date by submission of a current copy of the property register (Spain: NOTA SIMPLE INFORMATIVA ), plus 1 year of exclusive right to sell the property .

Provision
1.   Registration with I.C.E. S.L. is free of charge. I.C.E. S.L. does not charge any fees for the submission if purchase offers:
2.   In the event of the sale of a property, a commission is due I.C.E. S.L..
3.   The commission is calculated by the sales price.
4.   Said commission is due immediately upon signing of the final purchase and sales contract and may be paid by either credit card, bank transfer or permission for bank withdrawel to I.C.E. S.L. In the event that I.C.E. S.L. is unable to collect such commission, the seller of the property in question will be responsible for any charges incurred by I.C.E. S.L. in relation to the collection process, if the seller is responsible for the delay.
5.   The seller will send a copy of the notarized official purchase and sales contract to I.C.E. S.L. by either e-mail, regular mail or telefax.
6.   The contracted party is obligated to pay the commsssion due to I.C.E. S.L. without solicitation by I.C.E. S.L.
7.   The seller is prohibited from circumventing the fee structure of I.C.E. S.L.
8.   The seller agrees to pay a fine to I.C.E. S.L. in the amount of 5% of the originally offered sales price plus 16% IVA/ VAT, in the event that the seller is not complying with the policies agreed upon in this contract.

Fees
The fee amounts to 1% of the original sales price as indicated in the contract with I.C.E. S.L., plus 16% IVA/ VAT. Symbol of trust Trading on the internet harbours risks related to the nature of the medium. For this reason we are asking you to provide us with a voluntary cerdit information. Despite all measures of security, it is always possible for contract partners to falsify information given to I.C.E. S.L..

General Rules
1.   The seller has to prepare an offer to sell. Such offer has to be described completely and in detail accompanied by text and photographs. All aspects of the property that may impact the decisionmaking process of a potential buyer have to be described truthfully and objectively.
2.   The qouted price to sell is understood to bet he final sales price including of all commissions resulting from this contract.
3.   The sale of a property through a thrid party is generally possible, however the agrred upon sales cimmission will remain due to I.C.E. S.L. (Brokers and agents)

Final Agreement
I.C.E. S.L. reserves the right to transfer ist rights and obligations resuling from this contract in whole or in part to a third party, as long as such transfer is announced to the contract partners 4 weeks before such transfer. In the event that such transfer does occur, the contract partner does not have the right to cancel his/ her contract with I.C.E. S.L. after he/ she has been notified of such transfer, by sending an email to info@ice-europa.de.

Liabilty Waiver
I.C.E. S.L. is not liabel for any damages to ist contract partners, other than such damages caused by breach of contract in whole or in part and only in case that I.C.E. S.L. or its management or legal representatives have been acting with gross negligence.
